AP NewsBreak: Texas refineries may get back $135M

PASADENA, Texas (AP) ? Three commissioners appointed by Gov. Rick Perry may grant some of the nation's largest refineries a tax refund of more than $135 million ? money Texas' cash-strapped schools and other local governments have been counting on to help pay teachers and provide other public services.

The refund would mean more pain for some communities after a year in which state lawmakers had to grapple with a $27 billion shortfall and slashed spending on public schools by more than $4 billion. Nearly half the refund would be taken from public schools, and those in cities where the refineries are based would be hurt the most.agr

"We were already cut at the knees as it is, but more cuts? It's appalling," said Patricia Gonzales, a single mother of 13-year-old twins at Park View Intermediate School in Pasadena, a refinery town just south of Houston. Gonzales was just elected president of the school's new parent-teacher organization, which was formed this summer after the state budget cuts left the school lacking everything from pencils to paper towels.

The Texas Commission on Environmental Quality is evaluating 16 requests for the refund, which concerns a piece of pollution-controlling equipment. If granted, the refund total for those requests could add up to more than $135 million, according to county tax data and application documents analyzed by The Associated Press. What's more, agency documents show that if the commission grants the requests, at least 12 other refineries that have not sought a refund also could qualify.

The three-person commission last year expressed some support for the refund, prompting concern the panel is preparing to side with the industry in the middle of a budget crisis.

Should the commission approve the request, it would fall in line with Perry's argument on the GOP presidential campaign trail that by being friendly to business he has attracted businesses and jobs to Texas while other states suffered.

"Gov. Perry appoints individuals who are qualified and willing to serve, and expects they will consider all of the facts and make the appropriate decision," said Lucy Nashed, a spokeswoman for Perry.

The refund request has to do with a piece of technology used by refineries to minimize pollution. Beginning in 2006, the U.S. Environmental Protection Agency began requiring refineries to remove sulfur dioxide from diesel and gasoline in an attempt to reduce vehicle pollution. Many refineries had to either upgrade existing "hydrotreater" units or purchase new, more effective equipment.

Valero first asked for the refund for six of its refineries in 2007, and wants payment retroactive to that year. Since then, at least four other companies have joined in and asked for the same retroactive refund.

Valero is arguing that the units should be exempt under a Texas law that says industrial plants don't have to pay taxes on equipment purchased to reduce on-site pollution. The law saves companies millions, and is meant to encourage investment in new technology.

At first, the request was denied. The commission's staff said the hydrotreaters reduce pollution in diesel and gas, not necessarily at the plant. In fact, staff said, the hydrotreaters actually increased sulfur dioxide pollution near the refineries because the toxic gas is now burned off in a flare.

Valero appealed, and the panel's chairman, Bryan Shaw, said last April that the Legislature likely intended a broader interpretation of the law. He instructed his staff to research whether they could award partial exemptions to Valero. Shaw declined to be interviewed for this story, saying it could present a conflict because the issue will be brought before him again.

Valero alone could potentially get a refund of more than $92 million, but spokesman Bill Day said the San Antonio-based company believes the final refund ? if approved ? would be much smaller. He said appraisers will ultimately decide the value of the refinery properties and it's unlikely the numbers will be as high as those the companies noted on the applications they submitted to the commission.

There is no timeline for a ruling. The slow pace of decision-making has left municipalities and school districts in an uncomfortable position in which they collect ? and spend ? money they could be forced to return, acknowledged Susana Hildebrand, a chief engineer at the TCEQ.

"We don't have a statutory deadline, so there's not a legal impetus," she said. "I understand the concern that the taxing authorities have."

Refunding tax money would be yet another hit for counties, cities and school districts that are already cutting corners and improvising to make up for lost funds. Schools alone could be forced to fork over $62.8 million, according to data compiled by the AP.

In smaller, more rural counties ? where property taxes from large industrial complexes provide a big chunk of funding for schools and government services ? the impact could be greater. For example, in Moore County, where a Valero refinery is seeking exemptions on two units, a $15.8 million refund would amount to more than $720 per person.

"If it was a good year and property values were up it wouldn't be so bad," said Hugh Landrom Jr, president of Hugh Landrom and Associates, an engineering firm that does industrial appraisals for Galveston and other counties that are home to large refineries and chemical plants.

"It's compounded by the state budget cuts that are being passed down to everybody," Landrom said.

And because of a complex law aimed at evening the playing field between areas that have large refineries ? and a strong tax base ? and those that don't, all schools in the state would ultimately be impacted if the abatement is approved, though refinery towns would be hurt the most, said David Hodgins, consultant and attorney for the Texas Association of School Administrators.

"The dollars that are lost by these school districts directly affect the children of the employees that help make these companies what they are," Hodgins said.

For Gonzales and other parents in Pasadena, the prospect of the school district having to hand back money is terrifying. Already, the middle school her children attend has laid off eight staff members and is asking for parents to donate money to pay for basketballs, volleyballs and even gloves for the science teachers, Gonzales said.

The mom-turned-activist said she learned about the refineries' requests while lobbying earlier this year to convince Perry and the Legislature to dip into the state's so-called rainy day fund to ease cuts to the schools ? an effort that failed.

Gonzales lives near a miles-long stretch of refineries, where massive pipes and stacks light the night like skyscrapers do in other cities. An intense, burnt chemical scent hangs over the town.

"You smell it. That's what we're known for. Stinkadena because of the refineries," Gonzales said. "There are days when we can't go out because our children's asthma is that bad ... and then they want money back?"

Valero said no one ? not the refinery owners, municipalities, commission or appraisal districts ? knows how much the industry could get if a refund is granted.

"It's not going to be a disaster," said Day, the company spokesman.

"I guarantee you, it's not a surprise to the school districts," he added. "Yes, they spent the money, yes we're asking for an abatement on our pollution control equipment ... but this is really no different than a homeowner appealing their property tax, just on a larger scale."

In the meantime, Gonzales and other parents are planning to sell "$10,000 brownies" ? a gimmick aimed at raising awareness about how much money they would have to raise to make up for the lost refinery funds. The group also plans to boycott gas stations if necessary to fight the request.

"We pay taxes every day. Small businesses pay taxes. Why should big corporations get breaks?" she asked.

However, analysts said the new Tizen platform is likely to struggle to attract wider developer and manufacturer support to compete with the dozen or so other mobile operating systems in a market dominated by Apple and Google's Linux-based Android.

Even industry majors Nokia and Hewlett-Packard have ditched their mobile platforms this year.

"The best hope for them is that big operators get worried by Android's increasing smartphone dominance and decide to consciously switch their allegiances to rival platforms to restrict Google's huge influence over the mobile market," said analyst Neil Mawston from Strategy Analytics.

LiMo Foundation and the Linux Foundation said the new Tizen platform is an open-source, standards-based software platform that supports multiple devices including smartphones, tablets, smart TVs, netbooks and in-vehicle 'infotainment' systems.

The initial release is planned for the first quarter of 2012, enabling the first devices using Tizen to come to market in mid-2012, the two groups said.

The world's largest semiconductor firm Intel, which also has its own MeeGo Linux system, and Samsung Electronics, the second biggest maker of cell phones and one of the key contributors to LiMo, will head the technical steering committee developing Tizen.

"Tizen aims to unify a number of marginalized Linux based platforms," said Geoff Blaber, an analyst at London-based telecoms industry consultancy CCS Insight.

"There is a willingness to create an independent alternative to Android but history tells us that willingness doesn't necessarily equate to success," he added.

Samsung is the leading user of the Android platform, but some other makers of Android-operated phones have begun to look at alternatives since Google agreed to buy Motorola Mobility last month for $12.5 billion.

"Samsung might be further tempted to try a new system as Google's acquisition of Motorola Mobility raised uncertainty over the future of Android," said Song Jong-ho, an analyst at Daewoo Securities.

A spokesman for Samsung said: "We've been a core Linux partner ... and this is in line with our strategy of supporting many platforms."

Earlier this month Intel and Google launched a development partnership to adapt Android for Intel's Atom processor chips, with a view to having the first Android phones featuring Intel chips in the first half of next year.

Linux is the most popular type of free, or open-source, computer operating system which allows the public to use, revise and share. Linux suppliers earn money selling improvements and technical services.

It wouldn?t sur?prise me in any way if the vast realm of Skyrim was a real place. When you look off into the dis?tance, your view seems as real as the room around you. If you can see it, you can go there. Like the look of that open plain? Off you go. Want to throw your?self off the top of that moun?tain? Climb away! The mas?sive world that has been cre?ated in the new Elder Scrolls title puts its pre?de?ces?sors to?shame.

Every sin?gle part of the world, no mat?ter where it is, looks just as per?fect as the rest of it. From the faces of the peo?ple you encounter to the peak of the tallest moun?tain, every?thing is ren?dered per?fectly, and no detail is miss?ing. When Bethesda set out to cre?ate a fully expan?sive land for our explo?ration plea?sure, they really did it?right.

Apart from its graph?i?cal tri?umphs, there is one other vital thing that the game has in spades: ease of?use.

Com?pared to the some?what clunky and awk?ward con?trols and com?pli?cated lev?el?ling sys?tems that were bun?dled with Mor?rowind and, to a lesser extent,?Obliv?ion,?Skyrim presents an eas?ier way to play the game. It?s sim?ple, and it?s been done before, but it?s been toned down to be less intru?sive and more understandable.

The game has a lot more to offer, as always is the case with Elder Scrolls games, than what is sim?ply in the main quest. There are all sorts of small set?tle?ments wait?ing to be explored, but that goes with?out say?ing. In short, the expan?sive game envi?ron?ment we have all been wait?ing for is Skyrim.

There was some con?cerned??feed?back from other expo atten?dees that graph?i?cally, Skyrim didn?t look that great, but I per?son?ally thought it was visu?ally astound?ing. Nev?er?the?less, once you get up close to objects, the detail is most cer?tainly there. Walk?ing through the wilder?ness was quite sim?ply incred?i?ble. Bethesda has really gone all-out in terms of scale ? the vis?tas in Skyrim are awe-inspiring and the draw dis?tance was prac?ti?cally endless.

Again, the atmos?phere is what really sold Skyrim to me. The epic sound?track made my adven?ture seem all the bet?ter. I started off in the world after emerg?ing from a cave. While Tom headed to the town of River?wood, I opted for the hilly, moun?tain?ous path. Along the way, many deer and rab?bits ran past my char?ac?ter ? it is prob?a?bly the most atmos?pheric rep?re?sen?ta?tion of nature that I?ve seen in a?game.

I stum?bled across a few bod?ies and a destroyed cart to sud?denly find myself ambushed by some Nords. Draw?ing my sword, I engaged in com?bat. The fight?ing in Skyrim is Elder Scrolls through and through, and each enemy is an indi?vid?ual challenge.

The ran?dom events that occurred along the way were equally impres?sive. I shame?fully killed a trader and stole her horse, only to then come to the res?cue of a fair maiden that was being harassed by two strange men. Need?less to say, they won?t be try?ing that?again.

In short, Skyrim looks set to be an in-depth and engag?ing expe?ri?ence. Every?thing you loved about either Mor?rowind or Obliv?ion has been faith?fully trans?ferred across and tweaked where appro?pri?ate. This is def?i?nitely a must-buy on 11 November!

Question by Nikki: Property Taxes question? I?m thinking about moving to my home town in upstate NY, Real Estate there??.
is super cheap? But, how do I find out what I would have to pay in property taxes. I have heard the property taxes are pretty expensive for the city I want to live in but I just don?t know how expensive.

They are usually on the MLS listing for a property unless the realtor is a slacker You can look up some online and check those out.

You can also do a web search for the county online. Most have a ?real estate lookup? you can use (search for real estate) that allows you to access public records, which include property taxes.

Your Career: Whistleblower cases on rise

Employees are increasingly willing these days to blow the whistle when they see fraud, corruption and general unlawful behavior at their employers.

Since 2005, there?s been a spike in whistleblower cases filed with the federal government, according to the Department of Labor?s Occupational Safety and Health Administration, or OSHA. And one of the biggest labor law firms in the country, representing employers, has experienced such a big increase in worker snitching that it has created a special whistleblower practice to handle the extra workload.

?Any uptick is a good sign,? said Geoffrey Rapp, the Harold A. Anderson Professor of Law and Values at the University of Toledo?s College of Law, about an increase in whistleblower charges. ?The goal here is to get information about fraud before it becomes so serious, as in the collapse of [Bernard] Madoff and Enron, where the whole company falls apart, or the economy falls apart.?

It?s a trend that labor and shareholder advocates applaud, but corporations dread, and it?s intensified in recent months for a host of reasons, according to legal experts.

A new law providing monetary rewards for whistleblowers kicked in last month (in addition to scores of federal and states whistleblower protections put in place in recent years). There?s also a growing desire on the part of citizens to step up when they see wrongdoing following an economic downturn largely caused by malfeasance in corporate America. And there has been a beefing up of government enforcement to protect citizens who come forward with their accounts of misconduct from retaliation.

Indeed, just last week OSHA announced it had ordered Bank of America to pay a whistleblower $930,000 in interest and back wages and reinstate the employee.

?It?s clear from our investigation that Bank of America used illegal retaliatory tactics against this employee,? said David Michaels, OSHA?s Assistant Secretary. ?This employee showed great courage reporting potential fraud and standing up for the rights of other employees to do the same.?

The agency, which administers a host of whistleblower protections under 21 different laws, including not only labor safety laws, but also those under Sarbanes-Oxley Act and the Consumer Financial Protection Act, has seen a jump in whistleblower charges, reaching 2,339 through Sept. 14 of this year, compared to a total of 2,319 for all of 2010, and 2,158 in 2009.

And corporate labor law giant Littler Mendelson has seen a 25 percent jump whistleblower and retaliation claims firm-wide between 2009 and 2011, prompting the firm earlier this month to create a stand-alone Whistleblowing & Retaliation Practice.

?In my own personal experience, I have seen a 200 percent increase in the number of whistleblower claims I am handling in 2010 to 2011 compared to 2009 to 2010,? said Gregory Keating, co-chair of Littler?s new whistleblower practice and author of ?Retaliation and Whistleblowing: A Guide for Human Resources Professionals and Counsel.?

Keating believes much of the uptick has to do with the expansion of remedies for whistleblowers and the increase in enforcement.

?Leading up to 2010, you already had continued expansion of rights, remedies and the regulatory environment becoming more employee friendly,? he explained. ?Then came Dodd Frank and dramatically expanded the world of whistle blowing and created a fundamental sea change where the federal government decided to no longer just protect the whistleblowers but also going to incentivize them and create a bounty program.?

The Dodd-Frank financial reform law created more incentives, including a whistleblower reward that went into effect in August, for employees to step forward, something that?s very difficult for them to do because they can lose their jobs as a result, and many have. The legislation actually calls for financial incentives of up to 30 percent of funds recovered for information employees give regulators that leads to prosecution of securities fraud. The financial incentive, Keating said, is driving some employees to make unsubstantiated claims. He said he?s seen cases where employees who were on the ropes because of their job performance threatened to blow the whistle.

Not everyone has a problem with the monetary inducement.

?If its encouraging them to blow the whistle on wrongdoing then it?s fine,? said Bartlett Collins Naylor, financial policy advocate with Public Citizen. With thousands of public companies and a limited number of government enforcers, he continued, ?we have to depend on other avenues of enforcement and honest people within corporations are pivotal.?

Maybe we should be working longer

The monetary reward may also be that added incentive for someone who is reluctant to come forward, said Stuart Meissner, a New York attorney who represents whistleblowers and has gotten upwards of 120 inquiries from employees since the bounty went into effect, and has taken on about eight cases thus far.

?I think people still have inhibitions of being a whistleblower but certainly having the bounty out there entices them to take the risk of coming forward,? Meissner said.

He produced a whistleblower commercial and website called ?SECSnitch? to encourage people to come forward, which some management lawyers have pointed to as an example of an unsettling tactic being used to get employees to tattletale on their bosses if they?re disgruntled and looking for a big payout.

To the criticism, Meissner said, whistleblowers have to substantiate their claims and, according the bounty statute, can only collect a bounty if a million-plus dollars in sanctions is actually ordered by the government.

?If the claim is valid,? he added, ?whether they?re disgruntled or not is irrelevant.?

And beyond the bounty, some see the increase in people willing to step forward when they see wrongdoing as a sign of the times.

?We live in an era where people are more open about second-guessing institutional activity,? said Reuben Guttman, an attorney for Grant & Eisenhofer, a law firm that focuses on corporate governance and fraud, adding that the financial implosion and economic collapse has caused many people to ?open their eye[s]. Entities we thought were reputable may be making misrepresentations and not telling the truth about what they?re doing.?
